# Terms of Service - Football Play Card
### 1. Introduction and Acceptance
These Terms of Service ("Terms") govern your use of the Football Play Card website, web application, and iOS and Android apps (the "Platform"), operated by Championship App Development, LLC ("Football Play Card," "we," "us"). They apply to everyone who uses the Platform: coaches, league owners and team administrators, players, parents and guardians, family members, friends and fans, scorekeepers, marketplace buyers and sellers, and website visitors.
You accept these Terms when you check a box or tap a button that says so at checkout or sign-up, when you accept an invitation, or when you otherwise use the Platform. If you accept on behalf of a team, league, club, school or other organization, you confirm you are authorized to bind it, and "you" includes that organization.
**SECTION 16 REQUIRES INDIVIDUAL BINDING ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS, UNLESS YOU OPT OUT AS DESCRIBED THERE.**

### 2. Definitions
- **User**: anyone using the Platform.
- **Organization**: a team, league, club, school or other group using the Platform.
- **Coach**: a user with staff access to a team, including head coaches, assistant coaches and team administrators.
- **League Owner**: a user who administers a league and the teams in it.
- **Player**: an athlete on a team's roster, whether or not they hold an account. Players with accounts may view team content, RSVP, take quizzes and use team chat as their team allows.
- **Parent/Guardian**: a user a team has linked to a Player as that Player's parent or legal guardian.
- **Follower**: a Parent/Guardian, Family & Friend or Fan: the three access levels a team can give a follower.
- **Scorekeeper**: a user a team authorizes to keep score.
- **Minor**: anyone under 18, or under the age of majority where they live. **Child**: anyone under 13.
- **Team Plan**: a subscription plan allowing unlimited coach users and unlimited player accounts.
- **User Content**: anything users submit, including plays, playbooks, diagrams, notes, chat messages, comments, photos, video, live streams, recordings, schedules and RSVPs.
- **Player Data**: information about a Player entered by a Coach, League Owner, Parent/Guardian or other user, such as name, jersey number, positions, contact details, notes, RSVPs and quiz results.
- **We, us, our**: Football Play Card.
### 3. Accounts, Age and Eligibility
**3.1 Your account.** You are responsible for keeping your credentials confidential and for all activity under your account. Tell us right away at support@footballplaycard.com if you suspect unauthorized use. Give accurate information and keep it current. One account per person; do not create an account for anyone else.
**3.2 Minimum age.** You must be at least 13 to create an account. If you are a Minor, you may use the Platform only with permission from a parent or legal guardian who has read and agreed to these Terms for you. A parent or guardian who lets a Minor use the Platform agrees to these Terms on the Minor's behalf and is responsible for the Minor's use.
**3.3 Children.** Children may not create accounts. A Child may appear on a team only as a roster entry managed by a Coach or League Owner, and takes part through a Parent/Guardian's account. Teams set to Under 13 have no player accounts, and Parents/Guardians RSVP, take quizzes, view the schedule and use team chat for the player. On other teams a Coach can mark a player as under 13, and a player accepting an invite gives a birth month and year; if they are under 13, no account is created. If we learn a Child has an account, we delete the account and the information the Child submitted, such as RSVPs and quiz answers. The Child stays on the team's roster as an entry managed by the Coach and any linked Parent/Guardian.
**3.4 Invitations.** Invitations are personal. Do not forward an invitation or share an invitation link. An invitation can be accepted only with the email address it was sent to. Coaches and League Owners are responsible for whom they invite and the access level they grant, and must remove anyone who should no longer have access.
**3.5 Who may not use the Platform.** You may not use the Platform if you are required to register as a sex offender in any jurisdiction, have been convicted of a crime involving a minor, or are suspended or banned by the U.S. Center for SafeSport or a sports governing body from contact with minors. We do not run background checks on users or verify these statements. Leagues, schools and teams are responsible for screening their coaches and volunteers.
**3.6 Suspension.** We may suspend or terminate accounts that violate these Terms, our Community Guidelines or the law, or that we reasonably believe put Minors or other users at risk.
### 4. Subscriptions and Payments
- Football Play Card offers subscription-based access through plan tiers for individuals and teams. All plans include unlimited player accounts; Team Plans include unlimited coaches. Users may add single coach licenses to individual plans.
- Free trials convert to a paid plan automatically unless you cancel before the trial ends. Prices, billing intervals and trial lengths are shown at checkout and in confirmation emails.
- Free trials are for first-time subscribers and are limited to one per person, team, or organization. If you or your team have previously had a Football Play Card free trial or paid subscription, you are not eligible for another free trial, including after cancelling, changing plans, or signing up with a different email address, account, or payment method.
- We may use account, contact, and payment information to confirm trial eligibility. If a signup is not eligible, we may decline or cancel the free trial before any charge, or, where shown at checkout, start the paid subscription immediately. Creating additional accounts or using different contact or payment details to obtain more free trials violates these Terms and may result in suspension or termination of all related accounts.
- You may cancel at any time in your account settings or by contacting support@footballplaycard.com. Cancellation takes effect at the end of your current billing period, and you keep access until then.
- Payments on our website, including subscriptions started in our iOS app in the United States, are processed by Stripe. Purchases made through Apple's or Google's in-app purchase systems are processed by Apple or Google, and that store's terms govern their billing, renewal, cancellation and refunds. We do not store full payment card numbers.
- Upgrades are prorated; downgrades are credited toward future billing. Refunds are generally not provided, except where the law requires.
- Physical products, such as wristbands, are covered by our Return Policy at footballplaycard.com/return-policy.
**League and team fees.** When you pay a league or team fee through the Platform, you are paying that league or team, not Football Play Card. The league or team sets the fee and its refund policy; Stripe processes the payment on its behalf.
### 5. Use of the Platform and Conduct
We grant you a limited, non-exclusive, non-transferable license to use the Platform for its intended purposes, revocable if your account ends, you violate these Terms, or you do not keep an active subscription where one is required. All intellectual property in the Platform, including software, interface designs, text and graphics, belongs to Football Play Card.
You may:
- Create custom plays, formations, fronts and coverages.
- Share playbooks and content within your team or organization, and share individual plays by link where the Platform offers it. Don't share a play by link if its video shows a Minor whose parent or guardian hasn't agreed.
- Print wristbands and playbooks.
- Invite players, coaches, parents/guardians and followers to view and take part in team content.
- Add player names and initials to diagrams, and annotate plays with notes.
You may not:
- Upload content that infringes anyone's intellectual property.
- Scrape, crawl or index the Platform, or use automated tools to extract data.
- Use the Platform to benchmark or evaluate competing products.
- Interfere with security features, access the Platform without authorization, or reverse-engineer or interfere with our systems.
- Use the Platform for illegal or deceptive purposes.
- Harass, bully, threaten, intimidate, demean or discriminate against anyone.
- Post sexual content, or any content that sexualizes a Minor.
- Contact a Minor for any purpose unrelated to team activities, or try to move a conversation with a Minor to a private or off-Platform channel.
- Post anyone's personal information (home address, school, phone number, email) without permission.
- Share game or practice locations, schedules or rosters with people outside the team.
- Upload, post or stream images or video of anyone who has lawfully objected to it, including a Minor whose parent or guardian has lawfully objected.
- Impersonate anyone or misrepresent your relationship to a Player.
- Try to access a team you are not affiliated with, or forward invitations.
- Send spam, or advertise or ask for money for anything unrelated to your team.
**Community Guidelines.** Your use of chat, comments, video and live streaming must follow our Community Guidelines. We have zero tolerance for objectionable content and abusive users.
### 6. Team Communications, Video, Live Streaming and Locations
**6.1 Team communications are not private.** Team and event chat is visible to the members of each channel, and Coaches can see and delete messages in their team's channels. The Platform has no private one-to-one messages. Do not expect privacy in anything you post to a team. We keep messages, including deleted ones, as our Privacy Policy describes, and may review them to investigate reports, enforce these Terms and protect users. If a League Owner or school asks for a team's communications as part of a safety or conduct investigation, we may provide the relevant records after verifying the request and the requester's authority.
**6.2 Moderation.** We and a team's Coaches may remove any User Content, and restrict, suspend or remove any user from chat or the Platform, at any time and without notice. We do not pre-screen content and are not responsible for what other users post, but we act on violations we learn about.
**6.3 Reporting and removal requests.** To report a message, video, user or anything else on the Platform, or to ask us to remove something, email safety@footballplaycard.com with the team name, where it is and what happened, or tell your team's Coach. You don't need an account. We review reports promptly and handle the most serious first: threats, risks to a child's safety and sexual content involving a Minor get immediate attention, and we report child sexual exploitation to the National Center for Missing & Exploited Children as the law requires. We remove content and users that violate these Terms or our Community Guidelines. If an intimate image or video was shared without consent, including one of your child or someone you act for, tell us where it is, why you believe it was shared without consent and how to reach you, and sign with your name. "Removal request" in the subject gets it to us fastest. We remove it within 48 hours of a valid request and make reasonable efforts to find and remove identical copies. In an emergency, call 911 or your local emergency number.
**6.4 Notifications.** Push notifications may show part of a message and the sender's name on your lock screen. You can turn notifications off in your device settings and mute team announcements in the app.
**6.5 Video, live streaming and game recordings.** Team members and followers may upload photos and video and broadcast live as their role and the team's settings allow. Only signed-in team members and the Parent/Guardian and Family & Friend followers a team invites can open live streams and game recordings; Fans and the public cannot. Coaches may share a single play's video clip by link (Section 5), but not a full game. On teams with game videos turned on, broadcasts are also recorded and kept for the team as our Privacy Policy describes. The screen says so before you go live and while you stream. Broadcasters can mute audio; muted audio is neither streamed nor recorded. If you broadcast or upload, you confirm that you have every consent the law, your league, your school and the venue require, including a parent or guardian's consent for any Minor shown, and that their rules, including any broadcast-rights rules, allow recording. Never record or stream in locker rooms, restrooms or changing areas, or during medical treatment, and mute audio during huddles and private conversations. Do not download, screen-record or share recordings outside the team. If someone shown in a recording, or a Minor's parent or guardian, objects to it, they can ask the team's Coach to remove it or email safety@footballplaycard.com. We review each request, weighing safety, privacy and consent against the team's interest in its game record, and we may limit access to a recording while we review. We remove a recording when the law requires it, or when we believe it puts someone's safety at risk, such as under a court or protective order.
**6.6 Schedules and locations.** Event times and locations that Coaches enter are shown to team members and to the Followers the team invites, at the access level the Coach assigns. Use public venue addresses; do not enter a private home address unless everyone attending has agreed. Do not share a team's schedule, locations or roster outside the team. Fans see the venue and town, not the exact address, unless the team's head coach or League Owner chooses to show it.
### 7. Your Content and Our License
**7.1 Ownership.** You keep ownership of the User Content you create or upload.
**7.2 Our license.** You grant Football Play Card a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display and process your User Content only to operate, provide, secure and improve the Platform, including developing and training the artificial intelligence models that power its features (for video, only video uploaded or recorded on or after the effective date of these Terms), except that we never train on chat messages, private notes or Player Data, and as you and your team's settings direct. The license ends when the content is deleted from the Platform, except for copies we keep as our Privacy Policy or the law requires, content others have already shared within the team, and AI models trained before the deletion.
**7.3 What we will not do.** We do not sell or publicly share your User Content, except content you choose to list on the Marketplace or share by link, and we do not use it in our advertising without your permission.
**7.4 Our access.** We may access and review User Content and account activity to provide support, investigate reports, enforce these Terms and our Community Guidelines, protect users and comply with law, and to analyze usage to improve the Platform, as our Privacy Policy describes.
**7.5 Feedback.** If you submit feedback, suggestions or ideas to us, you grant us a perpetual, royalty-free, worldwide license to use, modify and incorporate them into the Platform without compensation. This license applies only to feedback you choose to submit, not to content you create or upload.
**7.6 AI features.** AI features help with tasks such as turning a play image into an editable diagram and grading short quiz answers. Their output may contain errors; check it before you rely on it.
**7.7 Recordings.** When you broadcast or upload video, you grant the team and us a license to keep the recording and show it to the team. Coaches control the team's recordings, and they stay with the team if you leave it or delete your account.
### 8. Players Who Are Minors
**8.1 Adding information about a Minor.** If you enter Player Data, or upload photos, video or streams showing a Minor, you confirm that you are the Minor's parent or guardian, or that you have told the parent or guardian and have any consent the law requires.
**8.2 Withdrawn consent.** If a parent or guardian withdraws consent, you will promptly remove the Minor's information, including names on plays, diagrams and notes, or ask the team's Coach to. We will delete a Child's Player Data, meaning their roster entry and the RSVPs, quiz results and notes linked to it, when their parent or guardian asks and we have verified the request, unless the law requires us to keep it. A request about video showing the Child is handled under Section 6.5.
**8.3 No sensitive information.** Do not enter health information, diagnoses, disability, disciplinary, immigration, financial-hardship or similar sensitive information about any Player, in notes or any other field.
**8.4 Parents and guardians.** A Parent/Guardian may review, correct or ask us to delete their child's information at any time, as our Privacy Policy describes. A Parent/Guardian can also answer RSVPs and quizzes for a child who has no account.
### 9. Coaches, League Owners and Organizations
**9.1 Your team.** If you are a Coach, League Owner or Organization, you are responsible for your team's activity on the Platform, the people you invite, the access you give them, and the Player Data you enter or import.
**9.2 Notice and consent.** Before you add a Minor's information or import a roster, you will tell each Minor's parent or guardian that your team uses Football Play Card, give them a link to our Privacy Policy, and get any consent the law, your league or your school requires. Keep records of those notices and consents and give them to us on request.
**9.3 Privacy requests.** You will answer, or forward to us, requests from players and parents about Player Data you manage. We may act directly on a verified request from a parent or guardian.
**9.4 Safe communication.** You will follow your league's, school's and governing body's policies on communicating with Minors, including U.S. Center for SafeSport policies where they apply, and keep communication with Minors in team channels other adults can see.
**9.5 Schools.** If your Organization is a school subject to FERPA, you designate Football Play Card as a school official with a legitimate educational interest in the student records you provide, such as rosters and contact details. We use those records only to provide the Platform to you. Videos your teams upload or record may also be used to train our AI features as our Privacy Policy describes, unless you ask us to exclude them at privacy@footballplaycard.com. You remain responsible for FERPA notices and parental consent. On request we will review your state's student data privacy agreement; once signed, it controls where it conflicts with these Terms.
**9.6 Government entities.** If you are a government entity, Sections 15 and 16 apply only as far as your jurisdiction's law permits.
### 10. Privacy
Our [Privacy Policy](https://footballplaycard.com/privacy-policy?hsLang=en) explains what we collect, including information about Players who are Minors, how we use and share it, our use of cookies and similar technologies, and your choices, including how to opt out.
### 11. Marketplace
If you buy or sell digital content (including playbooks and drills) through the Football Play Card Marketplace:
- Buyers receive a limited, non-transferable license to use purchased content to coach their own teams. With a paid subscription, buyers may edit, copy and adapt purchased content for their own teams; without one, purchased playbooks are view-only.
- All sales of Marketplace content are final and non-refundable, except where the law requires; digital goods cannot be returned or exchanged.
- Reselling, redistributing or publishing Marketplace content, or adapted versions of it, outside your own teams is prohibited without written permission from the Seller and Football Play Card.
- Sellers must agree to and follow our [Marketplace Seller Terms of Service](https://footballplaycard.com/football-play-card-marketplace-seller-terms-of-service?hsLang=en), including rules on content ownership, refunds and payouts.
- We may investigate suspected misuse or infringement and suspend accounts or remove content if violations occur.

### 12. Copyright Complaints
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act. Send notices to our designated agent: Copyright Agent, Championship App Development, LLC, 4474 Weston Rd #1030, Davie, FL 33331; legal@footballplaycard.com; (954) 834-3588. A notice must include: (1) your physical or electronic signature; (2) the copyrighted work claimed to be infringed; (3) the material claimed to infringe and where it is on the Platform; (4) your contact information; (5) a statement that you believe in good faith the use is not authorized by the owner, its agent or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act for the owner. When we receive a valid notice, we remove or disable access to the material and tell the user who posted it. If you believe your content was removed by mistake, you may send a counter-notice to the same agent with the information 17 U.S.C. 512(g)(3) requires. We terminate the accounts of repeat infringers in appropriate circumstances.
### 13. Account Deletion, Suspension and Termination
**13.1 Deleting your account.** You can ask us to delete your account at any time at footballplaycard.com/delete-account or by emailing privacy@footballplaycard.com. Deleting your account cancels any subscription you bought on our website immediately, with no refund for the rest of the billing period except where the law requires; subscriptions bought through Apple's or Google's in-app purchase must be cancelled in your App Store or Google Play settings. We then remove your personal details as our Privacy Policy Section 8.1 describes, and you can no longer sign in. Content you created or posted to a team stays on the Platform, shown as from a deleted user.
**13.2 Our rights.** We may suspend or terminate your account, or remove content, if you violate these Terms, our Community Guidelines or the law, if your use may harm the Platform or other users, or if we reasonably believe your account poses a risk to Minors.
**13.3 Effect.** When an account ends, access ends. We keep or delete account data as our Privacy Policy describes. Obligations that arose before termination survive it.
### 14. Disclaimers and Limitation of Liability
**14.1 As is.** The Platform is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
**14.2 Teams, events and users.** We do not organize, supervise or control teams, practices, games, events or venues. Teams supply schedules, locations and other event information, and we do not verify it. We are not responsible for the conduct of any user or Organization, online or offline; you are responsible for your interactions with others.
**14.3 Not an emergency service.** Do not use chat or any other part of the Platform to report an emergency. Call 911 or your local emergency number.
**14.4 Limitation.** To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for all claims is limited to the greater of what you paid us in the 12 months before the event that gave rise to the claim, or $100.
**14.5 Exceptions.** Nothing in these Terms limits liability that the law does not allow to be limited, such as for gross negligence, willful misconduct or fraud. Some states do not allow these limits, so they may not apply to you.
### 15. Indemnification
You will indemnify and hold Football Play Card harmless from third-party claims, and the resulting losses and reasonable legal fees, arising from your User Content, the Player Data you enter, your use of the Platform, your breach of these Terms, or your failure to obtain a consent these Terms require, except to the extent a claim arises from our own breach of these Terms, negligence or willful misconduct. We will tell you about any such claim, and you will not settle it without our consent. This section does not apply to a consumer where their state's law forbids it, or to a government entity beyond what Section 9.6 allows.
### 16. Dispute Resolution and Arbitration
**16.1 Governing law.** Florida law governs these Terms, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs this Section 16.
**16.2 Informal resolution first.** Before starting arbitration, you and we will try for 60 days to resolve the dispute informally. Send a written description of your claim, your contact details and the relief you want to legal@footballplaycard.com; we will send ours to your account email. Deadlines for bringing a claim are paused while we do.
**16.3 Arbitration.** A dispute not resolved informally will be decided by individual binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (its Commercial Arbitration Rules if you are an Organization). The hearing will be by video or phone, or in person in the county where you live if you prefer; if you are an Organization, any in-person hearing will be in Broward County, Florida. For consumer claims, we pay all filing, administration and arbitrator fees above what you would pay to file in court.
**16.4 Exceptions.** Either party may bring an individual claim in small-claims court, and either party may go to court to stop infringement of intellectual property.
**16.5 Class action waiver.** Claims may be brought only individually, never as a plaintiff or class member in any class, collective or representative proceeding. If this waiver is found unenforceable for a claim, that claim will be decided in court, not in arbitration.
**16.6 Mass filings.** If 25 or more similar demands are filed by or with the help of the same or coordinated counsel, they will be administered under the AAA's Mass Arbitration Supplementary Rules.
**16.7 Opt-out.** You may opt out of this arbitration agreement by emailing legal@footballplaycard.com with your name, account email and a clear statement that you opt out, within 30 days after you first accept these Terms (existing users: within 30 days after we notify you of this version).
**16.8 Minors.** If you are a Minor, your parent or guardian agrees to this Section on your behalf.
**16.9 Venue.** A claim not subject to arbitration will be brought in the state or federal courts in Broward County, Florida.
### 17. Export Compliance
You agree to comply with all applicable export and re-export control laws and regulations, including those of the United States. You represent that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods.
### 18. Additional Terms and App Store Terms
Certain features or services may be governed by additional terms. Where they apply, those terms supplement these Terms and, if they conflict, take priority.
**App stores.** If you downloaded our app from the Apple App Store or Google Play, these Terms are between you and Football Play Card, not Apple or Google. Apple and Google have no obligation to maintain or support the app. If the app fails to conform to a warranty, you may notify Apple, which may refund the app's purchase price; Apple has no other warranty obligation. Football Play Card, not Apple, handles any claim about the app, including product liability, failure to meet a legal or regulatory requirement, consumer protection and intellectual property claims. You must comply with any third-party terms (such as your wireless carrier's) when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not in a U.S.-embargoed country or on a U.S. government restricted-party list.
### 19. Changes to These Terms
We may update these Terms. For material changes, we will notify you by email or in the app at least 30 days before they take effect and, where required, ask you to accept them. Changes to Section 16 do not apply to disputes already pending. Continued use after a change takes effect means you accept it.
### 20. Miscellaneous
- **Force majeure.** We are not liable for failure or delay caused by events beyond our reasonable control, including acts of God, cyberattacks, internet outages or government restrictions.
- **Severability.** If any provision of these Terms is found invalid or unenforceable, the rest remains in full force.
- **Survival.** Sections 7, 8.1, 9, 11, 12, 14, 15, 16 and 20 survive termination, as does any other term that by its nature should.
- **Entire agreement.** These Terms, our Privacy Policy, our Community Guidelines, the Marketplace Seller Terms (for sellers) and any written agreement between you and us (such as a signed student data privacy agreement, which controls where it conflicts) are the entire agreement between you and Football Play Card.
